Terms and Conditions

These terms govern your use of the SIXTY iOS app and the website getsixty.co, operated by Noles Technology Inc., 8 The Green, Suite R, Dover, DE 19901, United States (“we”, “us”).
By downloading or using SIXTY you agree to these terms. If you do not agree, do not use it.

1. What SIXTY is, and what it is not
SIXTY is a habit tracker. It counts behaviour you record yourself and shows you your own history.
SIXTY is not medical or mental health treatment. It is not therapy, counselling, diagnosis, or a substitute for professional care. It is not a crisis service and it does not monitor you or intervene on your behalf. No part of the app is supervised by a clinician, and using it creates no clinical relationship of any kind.
Nothing in the app should be taken as a professional opinion about you, your partner, or your relationship. If you are struggling, speak to a qualified professional.
If you are in crisis or in danger, contact your local emergency services or a crisis line immediately. In the United States, call or text 988. Elsewhere, findahelpline.com lists services by country.
If someone else is at risk. SIXTY is designed for people whose jealousy is disproportionate to their situation. It is not a tool for monitoring, controlling or restricting another person. If your behaviour towards a partner has become controlling or frightening for them, SIXTY is not appropriate and you should seek support that addresses that directly.
2. No guarantee of results
We make no promise that SIXTY will reduce your jealousy, change your behaviour, or improve or preserve any relationship. Outcomes depend entirely on you and on circumstances outside our control. You use SIXTY at your own risk and remain solely responsible for what you say and do.
3. Eligibility
You must be at least 18 years old to use SIXTY.
4. Your data
Everything you enter in the app is stored on your device. We cannot access it, recover it, or restore it. This means:
- If you delete the app, or use Delete everything, your entries are gone permanently.
- Your entries do not transfer to a new device.
- We cannot help you recover lost entries under any circumstances.
You can export your data from Settings at any time, and we recommend doing so if it matters to you. How we handle information is set out in our Privacy Policy.
5. Subscriptions and payment
SIXTY offers auto-renewing subscriptions. All purchases are processed by Apple through your Apple ID.
Free trial. New subscribers may be offered a free trial. If you do not cancel at least 24 hours before the trial ends, your subscription begins and you will be charged.
Renewal. Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before the renewal date. Your Apple ID is charged within 24 hours of the period ending.
Cancelling. Manage or cancel your subscription in your Apple ID account settings. We cannot cancel it for you, and deleting the app does not cancel it.
Refunds. All payments are handled by Apple, and refunds are at Apple’s discretion under its own policies. Request one through Apple, not us. Unused portions of a free trial are forfeited when you purchase a subscription.
Price changes. We may change subscription prices. Existing subscribers will be notified by Apple and asked to consent before any increased price applies to them.
6. Acceptable use
You agree not to:
- Reverse engineer, decompile or attempt to extract the source code of the app
- Use SIXTY for any unlawful purpose, or to harass, monitor, control or intimidate another person
- Attempt to interfere with the app’s operation or security
- Resell, sublicense or redistribute the app or any part of it
We may suspend or terminate your access if you breach these terms.
7. Intellectual property
SIXTY, including its name, design, copy, and all software, is owned by Noles Technology Inc. and protected by copyright and other laws. You receive a limited, personal, non-transferable, revocable licence to use the app for your own purposes. No other rights are granted.
Content you write in the app is yours. Because it never reaches us, we claim no rights in it.
8. Submissions
If you send us feedback, suggestions, or written material for possible use in the app, you grant us a non-exclusive, royalty-free, worldwide licence to use it without compensation or attribution. Do not send us anything you are not happy for us to use, and do not send us anything confidential.
9. Third-party services
SIXTY relies on services operated by others, including Apple and RevenueCat, and the website relies on Netlify and Formspree. Their terms and policies govern their services, and we are not responsible for them.
The app links to external crisis and support resources. We provide those links as a convenience. We do not operate those services, endorse their content, or take responsibility for the help they provide.
10. Disclaimers
SIXTY is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that notifications and timers will always fire as intended.
Do not rely on SIXTY as your only safeguard against any behaviour with serious consequences.
11. Limitation of liability
To the maximum extent permitted by law, Noles Technology Inc. and its officers, directors, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, relationships, income or goodwill, arising from your use of or inability to use SIXTY, whether based in contract, tort, negligence, strict liability or otherwise, and whether or not we were advised of the possibility of such damages.
Our total aggregate liability for any claim relating to SIXTY will not exceed the greater of the amount you paid us in the twelve months before the claim arose, or fifty United States dollars.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions, the exclusions and limitations above apply only to the extent permitted, and nothing here limits liability that cannot lawfully be limited.
12. Indemnity
You agree to indemnify and hold harmless Noles Technology Inc. from any claim, demand, loss or expense, including reasonable legal fees, arising from your use of SIXTY or your breach of these terms.
13. Changes to these terms
We may update these terms. Material changes will be notified in the app or on the site, and the date at the top will be updated. Continuing to use SIXTY after a change means you accept the revised terms.
14. Termination
You may stop using SIXTY at any time by deleting the app. Cancel any active subscription separately through Apple. We may suspend or discontinue SIXTY, in whole or in part, at any time.
15. Governing law and disputes
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules. Any dispute will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.
If you are a consumer resident in the European Union or United Kingdom, nothing here deprives you of the protection of mandatory consumer law in your country of residence, or of your right to bring proceedings in your local courts.
16. General
If any provision of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between us regarding SIXTY.
